Legislation and Legalization essays A Study of the Inconsistency of the Application of the Death Penalty A well-dressed, young-looking businessman casually walks into a soaring skyscraper filled with over a thousand people who are all going about their normal lives, carrying out their daily routines. The businessman holds his briefcase in one hand and clenches his other hand into a tight fist. Nobody gives him a second glance as he walks through the tall, glass entrance doors. He looks perfectly normal to everyone in the building. However, these people do not realize that this mans typical-looking briefcase hides a considerable stockpile of high powered explosives. He calmly boards one of the buildings many elevators and presses the button labeled 30, the exact middle floor. He exits the elevator, impassively sets the briefcase on the floor, and returns to the lobby. Two minutes later, the bomb detonates. The blast reaches nearly fifteen of the buildings sixty floors, killing nearly three hundred people and injuring many more. A witness standing a block away from the building notices the businessman suspiciously walking away from the scene with no expression of fear or panic, and he chases after him. Later, the man pleads guilty to charges of first degree murder. He is sentenced to life in prison without parole. Why is he not given a sentence of death? Why is he not relieved of the right to live for the horrible crime he has committed? The reason is that the crime is committed in the state of Massachusetts, one of the 12 states in the United States of America that do not allow the death penalty as a form of punishment. This inconsistency in legislation causes many serious problems with justice, deterrence, and retribution. The primary problems lie, obviously, in the fact that some states do not allow the death penalty. We have many distractions while driving, let alone the use of cell phones as well. In this day and age cell phones are used for a variety of things such as text-messaging, internet usage, watching television, e-mailing, faxes, games, and much more. Driving is a privilege, not a right. Many Americans take the technology we have today for granted. Once issued a drivers license it can be revoked for not obeying the laws and this is not the case with cell phone usage while operating motor vehicles. The thing we need to remember is that we all need to be responsible drivers to ensure not only our safety but the safety of other drivers as well. According to the National Highway Traffic Safety Administration (NHTSA) nearly 6,000 people were killed in 2008 and more than 500,000 people were injured due to distractions while driving, which was in a published report in September 2009. Virginia Tech Transportation Institute reported in October 2009 that texting was the most dangerous of all cell phone activities. In September 2009 all government employees were banned texting while driving by an executive order that President Obama signed. In October 2009 there was a new bill introduced that offered financial incentives to states that ban cell phone use for both texting and talking. People who are texting would have doubled fines compared to those who are talking. Although this bill is still being debated on I think it will be something that we the people should encourage for these restrictions to apply. As of November 2010 there are currently twelve states that have no ban at all against cell phone use while operating motor vehicles and Ohio is one of them. There are eight states that have partial cell phone usage bans. Thirty states have a ban of no texting for all drivers. The United States has specifications on how these bans are enforced whether it is primary or secondary laws depending upon each state itself. Some of these laws are based more for the younger adult and teen drivers. This is a very hard issue to produce in legislation due to the fact that there is not anyway for an officer to catch you actually texting while driving. There is obviously no way to know exactly how many fatalities and injuries have occurred while driving with the use of cell hones, but we all know that it is stupid and we should not do it. Many surveys have been conducted for citizens to participate in on driving while using cell phones. In a recent study conducted by Nationwide Insurance Company the majority of the people that participated were all for any type of cell phone use while driving restrictions. Eighty percent of these people support a ban on text messaging while driving, as well as e-mailing while drivi ng. A ban for phone calls while driving had sixty-seven percent of respondents who were supportive of this act. Nearly three out of four of these respondents think these restrictions should be made for all drivers and not specific groups, such as younger adults, and teens. Texting while driving is one of the major concerns of cell phone usage while operating a motor vehicle. Anything can happen on the road in the blink of an eye and the most important thing while driving is to keep your eyes on the road, and drive responsibly. We need the slightest amount of distractions as possible. There are so many more distractions while driving let alone texting or cell phone use. In this day and age everyone is in such a hurry and multi-tasking is one of our biggest flaws when doing something as serious as operating a motor vehicle. We need to take a stand on this because so many lives are at stake when driving. Could you imagine getting a phone call that your child, mother, father, sister, brother, aunt, uncle, grandparent, niece, nephew, cousin, or any other family member, or friend had been hit by a driver while they were texting? Most of us would say â€Å"Oh that will never happen to me† but, when it does, it makes you sit back and think. Anything can happen at any given moment in this life. What would you do if it was you driving and hit your own family member, or friend? It would be devastating. Most of us don’t think of situations that could occur and turn into a tragedy such as this. I have to give a lot of credit to The University of Utah and there research studies in effort to stop this widespread issue of cell phone use while operating a motor vehicle. The University of Utah has conducted many studies to raise the awareness on this epidemic. They have also developed a method to keep drivers from being distracted by cell phones. This method is called Key2SafeDriving. It installs without any tools in seconds. It is something you would have to put money into, but it is well worth it to keep your child or any other relative safe, as well as the other people on the road. It is $99. 95 for each device including software for one cell phone. For each additional cell phone there is a $29. 95 fee for software. They do offer a thirty-day money back guarantee. This device will alert incoming text messages with an automatic response that you are driving. Any incoming calls while driving would be directed to your voicemail automatically. Although you can use hands-free handsets while driving such as Bluetooth’s. Emergency calls such as 911 are still always accessible while driving in safe mode. Your profiles are protected by passwords. This device does not use GPS. This is an inexpensive way to make sure you yourself, children, and family members are not tempted to use the cell phone while operating a motor vehicle. You have to remember that children often repeat the same things they see you do â€Å"monkey see, monkey do†. This would be an effective way to teach them not to text while driving. Another contributor to this debate is Oprah Winfrey. Ms. Winfrey kicked off the â€Å"No Phone Zone Day† on 30th day of April, in 2010. She is asking viewers to pledge not to use cell phones while driving. She is working with transportation safety organizations to declare this a national day to those who have lost their lives due to distracted drivers on cell phones. Ms. Winfrey stated, â€Å"We need to make our own movement to stop cell phoning and text messaging while driving. † â€Å"Don’t tempt fate; that text can wait. † She is trying to raise awareness of how serious the issue is of using your mobile devices while operating motor vehicles is as well. It’s not something we can overlook and she is taking all efforts to stop the deadly driving habits most Americans have formed. There were rallies held in Atlanta, Boston, Detroit, Los Angeles, and Washington D. C. on the 30th of April of this year. More than 160,000 people have pledged not to use their cell phones while driving. You should be the next! In conclusion we know what is right from wrong. If you see a friend using a cell phone while driving tell them it is very unsafe and they are being an irresponsible driver. If your friends use cell phones while operating motor vehicles that does not mean it is okay for you to do too! Two wrongs don’t make a right. Do not allow yourself to get into a vehicle with another person unless they give you their cell phone or they have the Key2Safe Driving installed. If you are old enough to drive you should know not to be using mobile devices while driving period. Our lives are precious and the last things we need are injuries or even deaths for something that can be prevented! This is an option of yours to make when you sit down in the driver seat of your car. One last thing I want to remind you of is taking the pledge created by Oprah Winfrey â€Å"No Phone Zone. A software process model is an abstract representation of a process. It presents a description of a process from some particular perspective as: The pure waterfall lifecycle consists of several nonoverlapping stages, as shown in the following figure. The model begins with establishing system requirements and  software requirements and continues with architectural  design, detailed design, coding, testing, and maintenance. Component-based software engineering : The system is assembled from existing components. System Requirements Software Requirements Architectural Design Detailed Design Coding There are many variants of these models e.g. formal development where a waterfall-like process is used, but the specification is formal that is refined through several stages to an implementable design[1]. This model is one of the oldest models and is  widely used in government projects and in many major  companies. As this model emphasizes planning in early  stages, it ensures design flaws before they develop. Requirements  analysis includes determining interaction needed with  other applications and databases, performance  requirements, user interface requirements, and so on. Architectural design: Determines the software  framework of a system to meet the specific  requirements. This design defines the major  components and the interaction of those components,  but it does not define the structure of each  component. The external interfaces and tools used in  the project can be determined by the designer. 4 Detailed design: Examines the software components  defined in the architectural design stage and produces  a specification for how each component is  implemented. 5 Coding: Implements specification. 6 7 the detailed starting coding. There is no overlap between stages. In  real-world development, however, one can discover issues  during the design or coding stages that point out errors or gaps in the requirements. The waterfall method does not prohibit returning to an  earlier phase, for example, returning from the design phase  to the requirements phase. However, this involves costly  rework. Each completed phase requires formal review and  extensive documentation development. Thus, oversights  made in the requirements phase are expensive to correct  later. Because the actual development comes late in the process,  one does not see results for a long time. This delay can be  disconcerting to management and customers. Many people  also think that the amount of documentation is excessive  and inflexible. Although the waterfall model has  instructive because it emphasizes  project development. Risk reduction spirals can be added to the top of the  waterfall to reduce risks prior to the waterfall phases. The waterfall can be further modified using options such as  prototyping, JADs or CRC sessions or other methods of  requirements gathering done in overlapping phases [5]. Weaknesses 3.2 Iterative Development ï‚ · Inflexible ï‚ · Only the final phase  produces a nondocumentation  deliverable. ï‚ · Backing up to address mistakes is difficult. The problems with the Waterfall Model created a demand  for a new method of developing systems which could  provide faster results, require less up-front information,  and offer greater flexibility. With Iterative Development,  the project is divided into small parts. This allows the  development team to demonstrate results earlier on in the  process and obtain valuable feedback from system users. Often, each iteration is actually a mini-Waterfall process  with the feedback from one phase providing vital  information for the design of the next phase. In a variation of this model, the software products, which are produced  at the end of each step (or series of steps), can go into  production immediately as incremental releases. ï‚ · Pure Waterfall Summary The pure waterfall model performs well for products with  clearly understood requirements or when working with  well understood technical tools, architectures and  infrastructures. Its weaknesses frequently make it  inadvisable when rapid development is needed. In those  cases, modified models may be more effective. ï‚ · 97 Modified Waterfall The modified waterfall uses the same phases as the pure  waterfall, but is not based on a discontinuous basis. This  enables the phases to overlap when needed. The pure  waterfall can also split into subprojects at an appropriate  phase (such as after the architectural design or detailed design). If there is personnel  continuity between the  phases, documentation  can be substantially reduced.  Implementation of easy  areas does not need to  wait for the hard ones. Activities performed  in parallel are subject  to miscommunication  and mistaken  assumptions. Unforeseen  interdependencies can  create problems. Fig. 4 Iterative Development. 3.3 V-Shaped Model Just like the waterfall model, the V-Shaped life cycle is a  sequential path of execution of processes. Each phase  must be completed before the next phase begins. Testing  is emphasized in this model more than the waterfall  model. The testing procedures are developed early in the  life cycle before any coding is done, during each of the  phases preceding implementation. Requirements begin the  life cycle model just like the waterfall model. However, the low-level  design phase lies where the actual software components  are designed, and unit tests are created in this phase as  well. Once coding is complete, the path of  execution continues up the right side of the V where the  test plans developed earlier are now put to use. ï‚ · Simple and easy to use. The spiral model  has four phases: Planning, Risk Analysis, Engineering and  Evaluation. A software project repeatedly passes through  these phases in iterations (called Spirals in this  model). The baseline spiral, starting in the planning  phase, requirements are gathered and risk is  assessed. Each subsequent spiral builds on the baseline  spiral. Requirements are gathered during the planning  phase. In the risk analysis phase, a process is undertaken  to identify risk and alternate solutions. A prototype is  produced at the end of the risk analysis phase. Software is  produced in the engineering phase, along with testing at  the end of the phase. The evaluation phase allows the  customer to evaluate the output of the project to date  before the project continues to the next spiral. In the spiral model, the angular component represents  progress, and the radius of the spiral represents cost. Fig. 5 V-Model [3] ï‚ · Disadvantages 1. 2. Very rigid like the waterfall model. Little flexibility and adjusting scope is difficult and  expensive.  Software is developed during the implementation phase,  so no early prototypes of the software are produced. This Model does not provide a clear path for problems  found during testing phases [7]. 3. 4. ï‚ · 1. 2. 3. Advantages High amount of risk analysis. Good for large and mission-critical projects. Software is produced early in the software life cycle. ï‚ · 1. 2. 3. Disadvantages Can be a costly model to use. Risk analysis requires highly specific expertise. Project’s success is highly dependent on the risk  analysis phase. Doesn’t work well for smaller projects [7]. 4. Identify and Evaluate Alternatives: Solicit  suggestions from stakeholders, evaluate them with respect  to stakeholders win conditions, synthesize and negotiate  candidate win-win alternatives, analyze, assess, resolve  win-lose or lose-lose risks, record commitments and areas  to be left flexible in the projects design record and life  cycle plans. 4. Cycle through the Spiral: Elaborate the win conditions  evaluate and screen alternatives, resolve risks, accumulate  appropriate commitments, and develop and execute  downstream plans [8]. 3.5 Extreme Programming An approach to development, based on the development  and delivery of very small increments of functionality. It  relies on constant code improvement, user involvement in  the development team and pair wise programming . It can  be difficult to keep the interest of customers who are  involved in the process. Team members may be unsuited  to the intense involvement that characterizes agile  methods. Prioritizing changes can be difficult where there  are multiple stakeholders. Maintaining simplicity requires  extra work. Contracts may be a problem as with other  approaches to iterative development. Fig. 7 Spiral Model of the Software Process[1]. ï‚ · WinWin Spiral Model The original spiral model [Boehm 88] began each cycle of  the spiral by performing the next level of elaboration of  the prospective systems objectives, constraints and  alternatives. A primary difficulty in applying the spiral  model has been the lack of explicit process guidance in  determining these objectives, constraints, and alternatives. The Win-Win Spiral Model [Boehm 94] uses the theory  W (win-win) approach [Boehm 89b] to converge on a  systems next-level objectives, constraints, and  alternatives. This Theory W approach involves identifying  the systems stakeholders and their win conditions, and  using negotiation processes to determine a mutually  satisfactory set of objectives, constraints, and alternatives for the stakeholders. In particular, as illustrated in the  figure, the nine-step Theory W process translates into the  following spiral model extensions: 1. Determine Objectives: Identify the system life-cycle  stakeholders and their win conditions and establish initial  system boundaries and external interfaces. 2. The developers break these stories into development Tasks. Small Releases: The minimal useful set of functionality that provides business value is developed first. Releases of the system are frequent and incrementally add functionality to the first release. Test first development: An automated unit test  framework is used to write tests for a new piece of  functionality before functionality itself is implemented.  Refactoring: All developers are expected to re-factor the  code continuously as soon as possible code improvements  are found. This keeps the code simple and maintainable.  Pair Programming: Developers work in pairs, checking  each other’s work and providing support to do a good job.  Collective Ownership: The pairs of developers work on  all areas of the system, so that no islands of expertise  develop and all the developers own all the code. Anyone  can change anything. Continuous Integration: As soon as work on a task is  complete, it is integrated into the whole system. After any  such integration, all the unit tests in the system must pass. Sustainable pace: Large amounts of over-time are not  considered acceptable as the net effect is often to reduce  code quality and medium term productivity.  On-site Customer: A representative of the end-user of the  system (the Customer) should be available full time for the  use of the XP team. In an extreme programming process,  the customer is a member of the development team and is  responsible for bringing system requirements to the team  for implementation. ï‚ · 1. 2. 3. 4. 5. XP and agile principles Incremental development is supported through small,  frequent system releases. Customer involvement means full-time customer  engagement with the team. People not process through pair programming,  collective ownership and a process that avoids long working hours. Waterfall model and spiral model are used commonly in developing systems. 4. Beholding the Beauty of Christ: A Blessed Paradox I.  Ã‚  Ã‚  Ã‚  Ã‚  Introduction A.  Ã‚  Ã‚  Ã‚  Ã‚  Central verse Psalms 27:4 â€Å"One thing have I desired of the Lord, That will I seek: That I may dwell in the house of the Lord all the days of my life, to behold the beauty of the Lord, and to inquire in His temple.† B.  Ã‚  Ã‚  Ã‚  Ã‚  The word â€Å"Beauty† as used here by David is the word â€Å"noam† which means splendor or agreeableness. C.  Ã‚  Ã‚  Ã‚  Ã‚  What makes Jesus Christ so admirable, precious, so beautiful, and so glorious is what Jonathan Edwards calls â€Å"an admirable conjunction of diverse excellencies.† The beauty and excellence of Christ is not a simple thing. It is a unique coming together in one person of extremely diverse qualities. Jesus has a glory in Himself that has a combing of attributes that would seem impossible in one person. He is unique, one of a kind. There is no one and nothing we could compare Him to. He is â€Å"Incomparable because in Him meet infinite glory and lowest humility, infinite majesty and transcendent meekness, deepest reverence toward God and equality with God, infinite worthiness of good and greatest patience to suffer evil, supreme dominion and exceeding obedience, divine self-sufficiency and childlike trust.† The Beauty and Excellency of Jesus is a coming together in one person of the perfect balance and proportion of extremely diverse qualities. He is a blessed paradox. I would like to explore 3 paradoxes of Jesus. II.  Ã‚  Ã‚  Ã‚  Ã‚  Paradox 1: Infinite Glory and Lowest Humility A.  Ã‚  Ã‚  Ã‚  Ã‚  Phil 2:5-7 â€Å"Let this mind be in you which was also in Christ Jesus, who being in the form of God, did not consider it robbery to be equal with God, but made Himself of no reputation taking on the form of a bondservant, and coming in the likeness of men.† B.  Ã‚  Ã‚  Ã‚  Ã‚  First, let us consider the infinite glory of Jesus. 1.  Ã‚  Ã‚  Ã‚  Ã‚  John 1:1,14 â€Å"In the beginning was the Word, and the Word was with God, and the Word was God.† Vs. 14 â€Å"And the Word became flesh and dwelt among us, and we beheld His glory as of the only begotten of the Father, full of grace and truth.† 2.  Ã‚  Ã‚  Ã‚  Ã‚  Jesus was as much God as the Father and Holy Spirit. McDonald is more than a restaurant; it had known to be a prominent symbol of American standard in fast food industries. And for this company to penetrate the Arab market where they’re a huge gap in cultures, it must have to do some necessary adjustments. Even though McDonald have a strong value of its name as a brand, it wont be easy to for a foreign company to gain the confidence of a country with a strong different believe and well established culture. You see not the all restaurant could sell their products in Middle East because of this situation. It is this culture of Middle East people that had set standard and limitation of what to eat and not. Arab people are very strict when it comes to this matter and everything should be according to their laws and religion. The concept of selling product exclusively for a particular region is an effective way to reach out their potential market. For example, the introduction of Mcarabia sandwich in the Middle East. There are two versions of this sandwich, the McArabia Grilled Chicken and Grilled Kofta, which is both, prepared only using ingredients that are acceptable with the Arab Religion. This is very important part of reaching out the Arab market. Just by naming it as â€Å"McArabia† makes the Arab people feel how they are being valued by McDonald restaurant. It reflects the sincere commitments of McDonalds to reach out the market of the gulf regions. Thus, it gained a warm acceptance with Arab market and it has shown with record of successful sales of the company. With the success of McDonald, it brought out a new interest to its Arab Market. It taught its customers how they could they could enjoy American products and still stick with their culture. However, this leads to into some modernization, which I believe is now acceptable with Arab leaders. For as long as there religion is always on top of consideration, changes are welcome to Arab market. Maybe this is the reason why there’s a lot establishment and products being produce in accordance with the â€Å"hajal† standard.a
